Pendente Lite Child Support/Custody
Pendente Lite support is not only limited to alimony. At the same time as the divorce suit is pending, if a parent has requested child support, the court may also hold a separate “pendente lite” hearing to determine and meet the children’s needs on a temporary basis. The support amount can be retroactively applied so that it accrues from the date of filing for divorce. If custody is requested, a pendente lite hearing can also be held for custody purposes. In both cases, an award of pendente lite child support or custody is not determinative of the amount of child support that will ultimately be awarded or to whom custody will be given.
